These Terms and Conditions ("Terms") govern your use of the Moana Flow Miami website (moanaflowmiami.com) and all boat and yacht charter services provided by Moana Flow Miami ("we," "us," or "our"), headquartered at 401 Biscayne Blvd, Miami, FL 33132.
By accessing our website or booking any charter service, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Charter Bookings & Reservations
- All charters are subject to availability and must be confirmed in writing (email or text) by a Moana Flow Miami representative.
- A booking is only confirmed upon receipt of a signed reservation agreement and applicable deposit payment.
- Charters are operated by a licensed USCG captain, with local fuel and standard safety gear provided, unless otherwise specified in writing.
- Optional add-ons (catering, DJ, decorations, water toys) are not included in the base price and must be arranged separately prior to your charter date.
2. Payment Terms
- A non-refundable deposit (amount specified in your booking agreement) is required to secure your charter date.
- The remaining balance is due no later than 7 days prior to the charter date, unless otherwise agreed in writing.
- Failure to make final payment by the due date may result in cancellation of your reservation.
- All prices are subject to applicable Florida state taxes and fees.
3. Cancellation & Rescheduling Policy
Please refer to our Cancellation Policy for full details on cancellations, reschedule requests, and refund eligibility. Key points include:
- Deposits are non-refundable under all circumstances.
- Cancellations made within a specified window before the charter date may result in forfeiture of additional payments.
- Rescheduling is subject to vessel availability and must be requested in writing.
- Moana Flow Miami reserves the right to cancel or reschedule a charter due to unsafe weather conditions or circumstances beyond our control. In such cases, we will offer a full rescheduled date at no additional charge.
4. Passenger Responsibilities & Code of Conduct
- All passengers must comply with the instructions of the captain and crew at all times. The captain has final authority over all safety and navigation decisions.
- Passengers must not exceed the maximum capacity of the chartered vessel.
- Consumption of illegal substances aboard any Moana Flow Miami vessel is strictly prohibited and grounds for immediate termination of the charter without refund.
- Excessive intoxication that endangers the safety of other passengers or the crew is grounds for immediate termination of the charter without refund.
- Guests are responsible for any damage caused to the vessel, equipment, or fixtures as a result of negligence or misconduct. The cost of repairs will be billed to the lead party.
- Glass bottles are not permitted on any vessel. Please use cans or plastic containers.
- We recommend reef-safe lotion sunscreen only. Spray sunscreens are prohibited aboard all vessels as they stain upholstery and create slip hazards on deck.
5. Age Requirements & Alcohol
- Consumption of alcohol is restricted to passengers who are 21 years of age or older, in accordance with Florida state law.
- Moana Flow Miami reserves the right to refuse service to any passenger who appears to be under the legal drinking age and cannot provide valid identification.
- Moana Flow Miami does not accept liability for the consequences of passenger alcohol consumption.
6. Liability & Waiver
- Participation in water-based activities (swimming, snorkeling, use of water toys) is entirely at the passenger's own risk.
- Moana Flow Miami and its captains and crew are not liable for any personal injury, illness, loss, or damage to personal property that occurs during a charter, except where such liability arises from gross negligence or willful misconduct on our part.
- All passengers may be required to sign a liability waiver prior to boarding.
- Moana Flow Miami is not responsible for delays caused by weather, traffic, mechanical issues beyond our control, or other circumstances outside our reasonable control.
7. Weather & Conditions
Miami's weather can be unpredictable. The captain has the sole authority to determine whether a charter can safely proceed, be modified, or must be postponed based on sea conditions, wind, lightning, or other factors. Safety is always our first priority.
8. Intellectual Property
All content on our website, including text, images, logos, and design, is the property of Moana Flow Miami and is protected by applicable copyright laws. You may not reproduce, distribute, or use our content without prior written permission.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States of America. Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the courts of Miami-Dade County, Florida.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
